SUPPLEMENTARY RENT AGREEMENT TO THE MAIN RENT AGREEMENT SIGNED ON 24th April 2009 BETWEEN THE FIRST PARTY AND THE SECOND PARTY IN RESPECT OF FLAT NO. 504 IN THE GREENWOODS GOVT. OFFICERS WELFARE SOCIETY PHASE II, OMEGA SECTOR, GREATER NOIDA, U.P.
 
 
            WHEREAS   on account of the reported problem of sudden drop in the number of expected hostel admissions by the Second Party due to delay in admissions this year in the colleges of Uttar Pradesh, the Second Party has given a month’s notice dated 28th September 2009 for surrender of the tenancy of the flat.
 
 AND WHEREAS considering it to be a temporary passing phase and expected overall improvement in the situation from the next academic year, the Second Party has subsequently approached the Lessors  (the First Party) of the flat, within the period of one month notice, with a request to accommodate it in terms of rent to be paid till the likely period of improvement in the situation.
 
            AND WHEREAS as a result of this reported development by the Second Party, the Lessors of the flat have had further discussions with the Second Party and have appreciated the difficulties faced by the Second Party and expressed their willingness to address the temporary concerns of the Second Party.
 
            AND WHEREAS the second party during mutual discussions has assured   the Lessors that the current development is a temporary phenomenon due to delay in admissions this year and the situation would improve from the next academic year.

            Now, therefore, this SUPPLEMENTARY AGREEMENT WITNESSETH and is hereby agreed to by and between the Lessors of the flat and the Second Party as under :-
 
1.            That one month’s notice dated 24th April 2009 given by the Second Party for surrender of flat is hereby treated as withdrawn and cancelled.
 
2.            That in partial modification of Para 1 of the Main Agreement dated 24.4.2009, the tenancy of above premises is extended till 30th March 2011.
 
3.            That in partial modification of Para 2 of the main agreement dated 24.4.2009, the Lessee shall pay to the Lessors the sum of Rs. 9000/- (Nine Thousand) [10000/- for 4 bed room flats) only as the monthly rent w.e.f. 1st November 2009 till 30th June 2010.
 
4.            That the other conditions of the Main Rent Agreement dated 24.4.2009 including the payment of monthly Society maintenance charges by Lessee as per Para 5 of the main Rent Agreement shall continue to be in force unaffected and unchanged as hitherto before.
 
5.            That in consideration of the aforesaid gesture on the part of the First Party, the Second Party agrees to the temporary suspension of its right to terminate the lease after giving one month’s notice in writing or rent in lieu thereof in terms of Para 8 of the Main Rent Agreement during the period of this Supplementary Agreement i.e. from 1st November 2009 till 30th March 2011.

6.            That subject to the aforesaid modifications brought about by this Supplementary Agreement regarding the monthly rent to be paid during the period from 1st November 2009 till 30th June 2010 because of the extra-ordinary situation this year, the monthly rent to be paid from 1st July 2010 shall be paid as per the terms and conditions of the Main Rent Agreement signed between the two parties on 24.4.2009 as per paras 2 & 3.
 
7.            That this Supplementary Agreement shall automatically come to an end on 30th June 2010 without any further action on the part of the two parties and further action will take place as per the Main Agreement dated 24.2.2009.
 
IN WITNESS whereof the Lessors and the Lessee have hereunder subscribed their hands on this the -----------------day of --------------------2009.
